By accepting this Terms and Conditions you are also accepting www.travel4baby.com website's Privacy Policy, Terms Of Use, and answers to questions listed on the website.

If you do not agree with any of our agreements you must cease pursuing the service from Hire 4 Baby SL immediately.

AGREEMENT BETWEEN CUSTOMER AND HIRE 4 BABY SL.

Welcome to the travel4baby.com website (the "Website"). This Website is provided solely to assist customers in gathering travel information, determining the availability of travel related goods and services, making legitimate reservations or otherwise transacting business with travel suppliers and/or ourselves, and for no other purposes. The terms "we", "us", "our", “Travel 4 Baby” refer to Hire 4 Baby SL, a Spanish governed company with Registered Number: B86705431, Head Office situated at Avenida Playa Paraiso, Adeje, 38678, Santa Cruz de Tenerife and its subsidiaries and corporate affiliates (collectively, the "Hire 4 Baby SL Companies"). “Hire 4 Baby SL Partners” means any co-branded and/or linked website through which we provide links, content or service. The term "you" refers to the customer visiting the Website and/or booking a reservation through us on this Website, or through our customer service agents. 

This Website is offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the "Terms of Use” or "Agreement"). Please read these Terms of Use carefully, as they contain important information about limitations of liability and resolution of disputes through arbitration rather than in court. You should also read our Privacy Policy, which also governs your use of the Website, and is incorporated by reference in this Agreement. By accessing or using this Website, booking any reservations for travel products or services on this Website, or contacting our call centre agents, you agree that the Terms of Use then in force shall apply. If you do not agree to the Terms of Use, please do not use or book any reservations through this Website or our call centre agents.

USE OF THE WEBSITE

As a condition of your use of this Website, you warrant that:

1.     you are at least 18 years of age;

2.     you possess the legal authority to create a binding legal obligation;

3.     you will use this Website in accordance with these Terms of Use;

4.     you will only use this Website to make legitimate reservations for you or for another person for whom you are legally authorised to act;

5.     you will inform such other persons about the Terms of Use that apply to the reservations you have made on their behalf, including all rules and restrictions applicable there to;

6.     all information supplied by you on this Website is true, accurate, current and complete; and if you have an travel4baby.com account, you will safeguard your account information and will supervise and be completely responsible for any use of your account by you and anyone other than you.

We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason, including, but not limited to, for violation of these Terms of Use. 

DISPUTES

Hire 4 Baby SL is committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns. But if we are unsuccessful, you may pursue claims as explained in this section. 

You agree to give us an opportunity to resolve any disputes or claims relating in any way to the Website, any dealings with our customer service agents, any services or products provided, any representations made by us, or our Privacy Policy (“Claims”) by contacting admin@travel4baby.com. If we are not able to resolve your Claims within 60 days.

The content and information on this Website (including, but not limited to, price and availability of travel services) as well as the infrastructure used to provide such content and information, is proprietary to us or our suppliers and providers. While you may make limited copies of your travel itinerary (and related documents) for travel or service reservations booked through this Website, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through this Website without prior consent. Additionally, you agree not to: 

1.     use this Website or its contents for any commercial purpose;

2.     make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;

3.     access, monitor or copy any content or information of this Website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;

4.     violate the restrictions in any robot exclusion headers on this Website or bypass or circumvent other measures employed to prevent or limit access to this Website;

5.     take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;

6.     deep link to any portion of this Website (including, without limitation, the purchase path for any travel services) for any purpose without our express written permission; or "frame", "mirror" or otherwise incorporate any part of this Website into any other website without our prior written authorisation.

If your booking or account shows signs of fraud, abuse or suspicious activity, Hire 4 Baby SL may cancel any travel or service reservations associated with your name, email address or account, and close any associated Hire 4 Baby SL accounts. If you have conducted any fraudulent activity, Hire 4 Baby SL reserves the right to take any necessary legal action and you may be liable for monetary losses to Hire 4 Baby SL, including litigation costs and damages. To contest the cancellation of a booking or freezing or closure of an account, please contact Our Customer Service Team.

PRIVACY POLICY

SUPPLIER RULES AND RESTRICTIONS

Additional terms and conditions will apply to your reservation and purchase of travel related goods and services that you select. Please read these additional terms and conditions carefully.

You acknowledge that some third-party providers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such supplier's rules and restrictions may result in cancellation of your reservation(s), if you are denied access to the applicable travel product or services, you automatically forfeit any money paid for such reservation(s), and/or in us debiting your account for any costs we incur as a result of such violation. 

Hire 4 Baby SL is not liable for any costs incurred due to hotel relocation.

BANK AND CREDIT CARD FEES

Your payment is processed in the European Union, when we process your payment. When the travel supplier processes your payment, it will be processed in the country in which the travel supplier is based.

Hire 4 Baby SL or the travel supplier may have to verify: (i) the validity of the payment card (through a charge of a nominal value that is either refunded within a few days or deducted from the final payment due to the travel supplier) and, (ii) the availability of funds on the payment card (to be confirmed by the bank issuing the your credit card).

Some banks and credit card companies impose fees for international or cross border transactions. For instance, if you are making a booking using a US-issued card with a non-US merchant, your bank may charge you a cross border or international transaction fee. Furthermore, booking international travel may be considered an international transaction by your bank or card company, since we may pass your card details to an international travel supplier to be charged. In addition, some banks and card companies impose fees for currency conversion. For instance, if you are making a booking in a currency other than the currency of your credit card, your credit card company may convert the booking amount to the currency of your credit card and charge you a conversion fee. The currency exchange rate and foreign transaction fee is determined solely by your bank on the day that they process the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your bank.

In such event, if available, we will offer you the opportunity to keep your reservation at the correct price or we will cancel your reservation without penalty.

Products and Booking Reservations

Hire 4 Baby SL provides the Platform through which you can enter into a contract with a third-party supplier of a product ("Supplier"). Hire 4 Baby SL is not a supplier of all products, and you may enter into a contract with a Hire 4 Baby SL Supplier with products you book, this will be directly between you and the applicable supplier. In respect of each booking, Hire 4 Baby SL acts as an agent for the supplier. However, the provision of the product you book will be subject to the terms and conditions displayed on the Website in respect of such product, any information made available to you during the booking process, and the terms and conditions of the supplier with whom you have a legal contract for the supply of the product.

If you make a booking, you agree to review and be bound by the applicable supplier's terms and conditions and any other rules or policies related to the product (the "Supplier Terms"). Notwithstanding the foregoing, to the extent that the supplier terms conflict with these terms of use in respect of your legal relationship with Hire 4 Baby SL, these terms of use shall prevail. Your interactions with Suppliers are at your own risk. Hire 4 Baby SL will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence of any Supplier or for any personal injuries, death, property damage, or other damages or expenses resulting from your interactions with any Supplier.

Hire 4 Baby SL is not a travel agency and does not provide or own all experiences available. Although travel4baby.com website acts with information about products and facilitates bookings, such actions do not in any way constitute Hire 4 Baby SL sponsorship, or any affiliation between Hire 4 Baby SL and any Supplier. Although Hire 4 Baby SL members may rate and review particular products based on their own experiences, Hire 4 Baby SL may recommend but it is the users choice to use the supplier or items. You agree that Hire 4 Baby SL is not responsible for the accuracy or completeness of information it obtains from Suppliers and/or that is displayed on the Website.

By making a Booking, you warrant that you are at least 18 years of age, that you possess the legal authority to enter into both this binding agreement and a binding agreement with the supplier, to use the services, to purchase the product, and that all information you supply is true and accurate. You further agree that you will use the platform to make only legitimate Bookings for you and/or others for whom you are legally authorized to act.

ACCOUNT TERMINATION

In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable law, Hire 4 Baby SL has adopted a policy of terminating, in appropriate circumstances and at Hire 4 Baby SL sole discretion, subscribers or account holders who are deemed to be repeat infringers. Hire 4 Baby SL may also at its sole discretion limit access to the Website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement. If you believe that an account holder or subscriber is a repeat infringer, please provide information sufficient for us to verify that the account holder or subscriber is a repeat infringer when filing your notice.

Cancellations

Excursion

1. You may only cancel the Service Agreements in accordance with the cancellation conditions as stated in the Supplier T&Cs.
2. To avoid misunderstandings, you must make changes and cancellations via www.travel4baby.com unless otherwise agreed. A cancellation can be made via email at excursions@travel4baby.com. The edit to your booking or cancellation must be made in good time; what is "in good time" depends on each individual case. Therefore, it is very important that you carefully read all terms and conditions, especially the Supplier T&Cs. If these conditions are met, we will issue a cancellation confirmation on behalf of the Supplier. This will serve as proof of the cancellation and therefore must be kept.
3. We can notify you of changes on behalf of the Supplier, especially if at short notice, by your provided telephone number and by sending changes to your email address.
4. If there are no different cancellation conditions to what Hire 4 Baby SL have:
   a) Cancellations more than 24 hours before the start of the activity: full refund of the booking price will be made
   b) For cancellations 24 hours or less before the start of the activity or in case of no-show: no refund of the booking price.

Rental Equipment

All orders must be cancelled 24 hours prior to your planned departure time provided in the booking, after this point all orders are non refundable and must be paid in full.

RENTAL EQUIPMENT:

All rental equipment are used at the renters risk of loss or injury of any type. The customer is responsible for any and all rented equipment from Hire 4 Baby SL and Hire 4 Baby SL Suppliers. You (The User) agree to hold Hire 4 Baby SL harmless and indemnify them and all people associated with the company including non Hire 4 Baby SL staff involved with delivery or pick up of the hire equipment such as hotel employees, 3rd party suppliers from any and all claims and or injuries up to and including death.

The renter is responsible for familiarising themselves with the proper operations of the hire equipment before using. Hire 4 Baby SL employees and suppliers will happily demonstrate the use of all products. If you require a demonstration of a product, it is you (The User) who must request a demonstration of the product prior to taking and using the items, once the product has been taken from Hire 4 Baby SL employee, Hire 4 Baby SL Supplier or collected from the drop off point, the user at this point agrees that the products are to the users satisfaction and are now liable for any damages occurred from this point, if you are not happy with the product you have received, you must make Hire 4 Baby SL or Hire 4 Baby SL Suppliers aware before initial use of the items.

Hire 4 Baby SL and Hire 4 Baby SL suppliers reserve the right to substitute equipment in the event equipment becomes unavailable to you due to availability, extensions or breakages. You will be notified as soon as possible regarding the issue, but can be as late as once you have arrived in resort. If we are unable to deliver a product due to premises access issues, we will contact you for an alternate destination to provide you with your equipment. If alternative arrangements cannot be made we reserve the right to cancel the order, we also reserve the right to charge the full amount if it is not seen as a fault by Hire 4 Baby SL or Hire 4 Baby SL suppliers. It is you (The User) to ensure items can be delivered to the requested destination prior to ordering equipment from Hire 4 Baby SL or Hire 4 Baby SL Suppliers.

You agree to abide by any and all local laws enforced upon renting any Hire 4 Baby SL or Hire 4 Baby SL suppliers equipment. You agree to use the hire equipment and/or collapse strollers in proper/safe areas and correctly at all times. 

The customer is responsible for theft, loss, or damage to all equipment and/or accessories. In the event of theft, loss, or damage of any Hire 4 Baby SL or Hire 4 Baby SL Suppliers equipment that are in the renters’ possession, the renter hereby authorises Hire 4 Baby SL or Hire 4 Baby SL suppliers to charge you (The User) for any costs to replace and/or repair lost or damaged equipment.

(Renter must also make all required reports to local police and/or the required documentation for Hire 4 Baby SL and its suppliers to make an insurance claim, by not doing so you agree to make the payment in full)

Hire equipment and accessories must be returned in the same condition originally received, this includes stains to fabrics including sun lotion. Failure to do so will result in an additional €20 fee for extra cleaning. (This applies to heavy soiling most commonly being sun lotion stains) 

Upon discovering any lost or missing items you must call your destination immediately or email them form the details given when placing your order. Failure to do so will result in the customer being charged for replacing the damaged or missing items.

Lost stroller accessory packs will result in a charge of €50 to replace the pack.

The renter agrees to return all equipment and accessories to original delivery location unless other arrangements have been made. To make other arrangements you must notify Hire 4 Baby SL or Hire 4 Baby SL Suppliers at your earliest convenience, if you do not receive a response we may not have received the new information and is down to you (The User) to ensure we have received and accepted the new details. Late equipment returns will be charged at €10 per collection attempt.

The renter is responsible upon receipt of all equipment to inspect the equipment for proper functionality before usage. If at any time during the rental period your equipment does not function properly cease usage immediately. After ceasing use, contact Hire 4 Baby SL or Hire 4 Baby SL Supplier to make arrangements for equipment to be collected (The customer will be liable to any damage made and asked to pay on collection). Customer will then have the option to continue the rental period with a replacement subject to availability at that time and damages paid.

Rental Equipment and Accessories are to be used exclusively by the renter only. At no point can the renter pass equipment on to third party at any time.

Your delivery/pick up site information may be disclosed with the destinations to Hire 4 Baby SL employees and Hire 4 Baby SL Suppliers employees. This is to ensure drop off and pick up of the rental equipment be easier and more efficient for your holiday. 

Fulfilment guarantee

If we are unable to deliver your order or offer a substitute for any reason we will issue a full refund on your order. 

Delays and deliveries

Hire 4 Baby SL and Hire 4 Baby SL Suppliers will monitor your flight status to ensure that you receive your items once you have landed in resort (you will contacted on arrival to arrange delivery time if required). If you have not received your items or an item is faulty, you have 24 hours from your arrival date and time to raise any issues with your order.

CUSTOMER AGREES TO INDEMNIFY, DEFEND, AND HOLD HIRE 4 BABY SL AND ITS AGENTS, HARMLESS FROM ANY CLAIMS, LIABILITIES (INCLUDING NEGLIGENCE, TORT AND STRICT LIABILITIES), EXPENSES, INCLUDING REASONABLE ATTORNEY’S FEES, ARISING FROM OR RESULTING FROM THE MANUFACTURE, POSSESSION, CONDITION, USE, OPERATION, HANDLING, TRANSPORTATION, AND/OR RETURN OF THE RENTED EQUIPMENT AND/OR CUSTOMER’S BREACH OF ANY TERM/CONDITION OF THIS AGREEMENT.

By accepting this rental agreement you agree to and acknowledge you have selected equipment that is acceptable for your needs. You understand Hire 4 Baby SL or Hire 4 Baby SL Suppliers are not the manufacturer or designer of the rental equipment or accessories. Hire 4 Baby SL and Hire 4 Baby SL Suppliers are not responsible to use manufacturers warranties for itself or the customer. You understand the rental equipment is rented as it is.

Baby video monitors are for use in the apartment, house and place of stay only. They are not to be used so the baby/child can be left unattended. It is the users responsibility to understand the range of the monitor and that it will work within the location required before renting. Hire 4 Baby SL does not take any responsibility for misuse of the product and requests that this item is only ordered if it is planned to be used for the reasons above.

Anyone giving false information to Hire 4 Baby SL at time of hire will result in an immediate termination of hire with immediate effect and no refund given. 

Hire 4 Baby SL will not tolerate anyone stealing or attempting to steal any rental equipment from Hire 4 Baby SL or Hire 4 Baby SL Suppliers and will result in full prosecution every time.

All orders must be placed 48 hours in advance on the website to receive a full service. For orders less than 48 hours, please proceed to placing your order at www.travel4baby.com and contact the details provided once your order is placed.

Airport deliveries

All airport deliveries must be paid in full prior to your arrival and received by us (Hire 4 Baby SL) to be able to deliver your required items. If your flight is delayed or cancelled we will monitor and amend accordingly. If you are delayed or have had to change your flight, it is your responsibility to contact your destination to confirm delivery is still available, this may be due to and not limiting to:

• Opening and closing hours
• Other Orders booked at this time
• Staff Availability

Car Seats

All car seats must be installed by yourself (The User). Hire 4 Baby SL employees and Hire 4 Baby SL Suppliers are not insured to install car seats at any point or for any reason and you the user agrees to take full responsibility of the car seats set up and installation. You (The User) agree to hold Hire 4 Baby SL and Hire 4 Baby SL Suppliers harmless and indemnify them and all employees associated with the company from any and all claims and or injuries upto and including death.
